Amended Anti-corruption Law promulgated

The President’s Office on August 27 made public the order of President Nguyen Minh Triet on the promulgation of the amended Anti-corruption Law.

The President’s Office on August 27 made public the order of President Nguyen Minh Triet on the promulgation of the amended Anti-corruption Law.

 

This amended law was approved by the 12th National Assembly on August 4 at its first session and took effect on the day of publication, August 17, 2007.

 

The Anti-corruption Law was ratified by the 11th National Assembly at the 8th session on November 29, 2005 and took effect on June 1, 2005.

 

According to Le Tien Hao, Government Vice Chief Inspector, in the more than one year of being in effect, the law has brought about positive results. However, the law needed to be amended to be appropriate to the actual situation of corruption and to the amended Law on National Assembly Organization.

 

Specifically, the law’s Article 73 was amended, related to the establishment of anti-corruption steering boards in provinces and cities in Vietnam, headed by chairmen of provincial and municipal People’s Committees.

 

Article 74 of the amended law stipulates the missions and power of the Committee of Justice of the National Assembly in supervising, discovering and solving corruption cases to replace the previous Committee of Law.

 

The National Assembly has assigned the government and the Central Anti-corruption Steering Committee to instruct provinces and cities to set up their anti-corruption steering boards. So far 20 provinces and cities have set up these boards.

 

The amended Anti-corruption Law stirred controversy at the National Assembly’s sessions before it was ratified. Some National Assembly deputies worried that as chairmen of provincial and municipal People’s Committees are the heads of local anti-corruption steering boards, the independence of justice agencies and objectivity might be affected.
